ARTICLE 2 - SUBJECT
 
The subject of this Contract is to determine the rights and obligations of the parties in accordance with the Law No. 6502 on the Protection of Consumers, the Distance Contracts Regulation published in the Official Gazette dated November 27, 2014"www.kaymazayakkabi.com" and the Warranty Certificate Regulation, regarding the sale and delivery of the product, of which qualifications and sales price are specified below, that the BUYER ordered electronically from the SELLER's website.

The type and kind, quantity, brand/model, color and sales price, and delivery information of the products are as specified below.
 
 
 
 
 
 
ARTICLE 4 - RIGHT OF WITHDRAWAL
 
- The BUYER has the right to withdraw from the Contract without giving any reason within 14 days from the delivery of the product to the BUYER or to the person/institution at the address indicated by the BUYER.
 
To exercise the right of withdrawal, it is necessary to notify the SELLER by fax, phone or electronic mail within the 14-day period and to send the product back to the SELLER according to the provisions of Article 5 of this Contract and according to the pre-information on the "http://www.kaymazayakkabi.com/" website. The product must not be damaged while its packaging or content is being tested and it should be in a state that allows the SELLER to resell it.
In case of withdrawal,
 
a) The invoice of the product delivered to the third party or the BUYER must be returned. (If the products to be returned are invoiced to a corporate entity, such corporation must also issue a return invoice when returning the product. Order returns without a return invoice will not be completed.)
 
b) The return form,
 
c) Unless the seller or supplier proposes to take back the goods themselves, the consumer must return the goods to the seller or supplier or to the person authorized by them within ten days from the notification that they exercised their right of withdrawal. The seller or supplier must refund all payments collected, including the delivery costs to the consumer, within fourteen days from when they were notified of the withdrawal. The product's box, packaging, and all standard accessories, if any, must be returned completely and without damage.
The cargo fee of the returned product within due time will be covered by the SELLER.
While returning the product to the SELLER, the original invoice presented to the BUYER during delivery must also be returned with the product. In the absence of the invoice, VAT and other legal obligations, if any, cannot be refunded to the BUYER. The returned invoice will include the statement "This is a return invoice" written and signed by the BUYER.
 
- Determination of Right to Withdraw Period
 
The withdrawal period starts on the day the contract is established for service contracts; or on the day the consumer or the third person designated by the consumer receives the goods for sales contracts. However, the consumer can also exercise the right of withdrawal within the period between the establishment of the contract and the delivery of the goods.
 
In determining the withdrawal period;
 
a) In the case of goods delivered separately where a single order is concerned, the day the last item is received by the consumer or a third party specified by the consumer,
 
b) In the case of goods consisting of multiple parts, the day the last part is received by the consumer or a third party specified by the consumer,
 
c) In contracts where goods are delivered on a regular basis for a specified period, the day the first item is received by the consumer or a third party determined by the consumer
 
is considered the start.
 
The delivery of the goods to the carrier by the seller is not considered as the delivery made to the consumer.
 
In contracts where goods and services are provided together, the provisions of the right of withdrawal for goods delivery will apply.
 
 
 
ARTICLE 5 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED
 
 
 
Unless otherwise agreed by the parties, the consumer cannot exercise the right of withdrawal in the following contracts:
 
a) Contracts for goods or services, the price of which depends on fluctuations in the financial markets and which are outside the control of the seller or supplier.
 
b) Contracts for goods prepared according to the wishes or personal needs of the consumer.
 
c) Contracts for the delivery of perishable goods, or goods that may expire quickly.
 
ç) Contracts for goods, which, after delivery, are inseparably mixed with other products, or where the protective elements such as packaging, tape, seal, package have been opened; and if their return is unsuitable for health and hygiene reasons.
 
d) Contracts for goods which, after delivery, are inseparably mixed with other products due to their nature.
 
e) Contracts for books, digital content, and computer consumables that are delivered in a physical environment with opened packaging, tape, seal, package.
